Providing services electronically
Customer, below we present the terms and conditions of our website, which contain information important to you, in particular related to the operation of our website, which involves the provision of services electronically, i.e. in particular in the form of contact via the contact form.
These Terms and Conditions were created with the legal requirements imposed on us in connection with our activities in mind. They outline the rights and obligations of both the customer and us, the website owner, including the operating procedures and available complaint procedures.

§ 1 Glossary
The following terms used in the regulations should be understood as:
- Regulations – regulations for the provision of services by electronic means within the meaning of the Act of 18 July 2002 on the provision of services by electronic means;
- Service Provider – Bista Standard Sp. z o. o. with its registered office in Bydgoszcz, address: ul. Smoleńska 29, 85-871 Bydgoszcz, which provides services electronically;
- Website - website operating at the Internet address https://bista.pl/;
- Customer/Service Recipient - a natural person, legal person or organizational unit without legal personality that uses a service provided electronically;
§ 2 General provisions
- These regulations specify:
- types and scope of services provided electronically and the conditions of their provision;
- conditions for concluding and terminating contracts for the provision of electronic services;
- complaint procedure.
- To the extent that electronic services are provided within the meaning of Act of 18 July 2002 on the provision of services by electronic means, these regulations constitute the regulation of the provision of services by electronic means.
- The type and scope of the service provided electronically on the Website is to enable contact with the Service Provider via the contact form, to enable the use of the contact form functionality – sending requests for quotations and other inquiries and receiving responses.
- The information published on the Website in the "Our brands" and "Catalogs" tabs does not constitute an offer within the meaning of Article 66(1) of the Civil Code, but serves only as commercial information of the Service Provider.
- Due to its product range, the Website (in particular the "Our brands" and "Catalogs" tabs) is intended solely for informational and commercial purposes between entities engaged in the production, distribution and trade of tobacco products, electronic cigarettes, refill containers or tobacco accessories and is intended solely for adults with full legal capacity.
§ 3 Providing services electronically
- Providing services electronically on the Website includes, in particular, the Service Provider's provision of service functionality in the form of a contact form. Under the regulations, providing services electronically means performing a service without the simultaneous presence of the parties (remotely), through the transmission of data at the individual request of the Service Recipient, sent and received using devices for electronic data processing and storage, which is entirely transmitted, received, or transmitted via a telecommunications network. It is subject to the regime Act of 18 July 2002 on the provision of services by electronic means.
- In order to cooperate with the IT system used by the Service Provider, it is necessary to meet the following minimum technical requirements: a working computer or telephone, tablet, internet browser, JavaScript support and acceptance of necessary Cookies.
- The Service Recipient is obliged in particular to:
- not providing or transmitting illegal content, i.e. content prohibited by law, e.g. content promoting violence, defamatory or violating personal rights and other rights of third parties;
- use the Website in a manner consistent with the provisions of the law in force in the territory of the Republic of Poland, the provisions of these regulations, as well as with the general principles of using the network.
- The Service Provider ensures the operation of the IT system it uses, enabling the Service Recipient to:
- The Service Provider ensures that the Service Recipient uses the service provided electronically in a way that prevents unauthorized persons from accessing the content of the communication comprising that service;
- if the nature of the service so requires, the Service Provider shall ensure unambiguous identification of the parties to the service provided electronically and confirmation of the fact of submitting declarations of intent and their content, necessary to conclude an agreement for the provision of this service electronically;
- termination, at any time, of the use of the service provided electronically by sending information by the Service User to the Service Provider about resigning from using the contact form functionality (cancellation of the inquiry/message sent via the form).
§ 4 Concluding and terminating contracts for the provision of services by electronic means
- The conclusion of a contract for the provision of services electronically on the Website involves using the Website and, in particular, using the functionality of the contact form, i.e. sending a request for quotation or other enquiry to the Service Provider or sending a message via the contact form available on the website https://bista.pl/ in the "Contact" tab.
- Termination of the contract for the provision of services by electronic means is possible at any time by terminating the use of the Website and by sending information by the Service User to the Service Provider about resigning from using the contact form functionality (cancellation of the inquiry/message sent via the form).
§ 5 Risks related to the provision of services and data security
- The systems and applications used by the Service Provider ensure a high standard of security and personal data protection. However, the Service User should be aware that using the Service requires the use of a public telecommunications network (the Internet), which increases the risk of threats arising from using the Service.
- The Service Provider informs that the use of services provided electronically may involve
The threat of malicious software being introduced into the Service Recipient's IT system and unauthorized persons obtaining and modifying their data may arise. To avoid the risk of threats, the Service Recipient should use appropriate technical measures to minimize their occurrence, in particular antivirus software and firewalls.
§ 6 Complaint procedure
- In the event of any concerns regarding the services provided electronically via the Website, such as technical issues with the operation of the Website, Service Users may submit a complaint to: biuro@bista.pl. In order for the complaint to be processed, it is necessary to provide the name, surname, and email address of the complainant, as well as a brief description of the complaint.
- Complaints will be reviewed within 14 days of receipt by the Service Provider. A decision regarding the complaint will be returned to the Service User to the email address from which it was submitted.
§ 7 Use of Personal data
- Detailed information regarding the processing of personal data can be found in the "Privacy Policy and Cookies" tab available at https://bista.pl/.
- In accordance with the provisions of the Regulation (EU) of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC, the Seller informs that:

NIP: 5542559901 (hereinafter referred to as the “Administrator”), e-mail: biuro@bista.pl, tel. +48 501 740 012; - Personal data will be processed by the controller for the purpose of providing services electronically (the processing of the following data in particular is necessary to achieve this purpose: name, surname, e-mail address), concluding and performing any contracts with the Client and protecting the legitimate interests of the controller;
- Personal data are processed on the basis of Article 6 paragraph 1 letter b of the aforementioned Regulation within the scope of execution and conclusion of the sales contract and provision of services by electronic means and on the basis of Article 6 paragraph 1 letter f of the aforementioned Regulation as necessary for the purposes of the legitimate interests pursued by the controller (i.e. fulfilling the requests of Service Users);
- The recipients of personal data will be entities participating in the implementation of the contract, including IT employees and the hosting provider;
- The processing period lasts until the contract is fulfilled and until the legitimate interest pursued by the controller ceases;
- You have the right to request from the controller access to your personal data, its rectification, erasure or restriction of processing, the right to object to the processing and the right to transfer data;
- You have the right to lodge a complaint with the supervisory authority;
- Providing personal data is voluntary, however, failure to provide them will make it impossible to conclude or perform a contract as a result of a possible request for quotation or to fulfill your requests/applications.
§ 8 Miscellaneous
- The Service Provider makes the Regulations available to the Service Recipient free of charge before concluding a contract for the provision of such services, and also - at the Service Recipient's request - in a manner that enables the acquisition, reproduction and recording of the content of the Regulations using the IT system used by the Service Recipient.
- In the event of disputes regarding claims arising from the provision of services by electronic means or complaints, the parties are entitled to use extrajudicial methods of dispute resolution, including mediation.
- The above rights do not exclude the possibility for the parties to pursue claims before a court under general principles.
- In matters not regulated in these Regulations, the relevant provisions of law shall apply.
- The Service Provider reserves the right to change the Regulations in the event of important reasons.
- The Seller will inform Customers about any changes to the Regulations by posting information about the changes to the Regulations on the Website.
